Waiver

Captain Vineyards 2022 Harvest and/or Bottling Events 

By attending Harvest and/or Bottling, you agree & accept these terms: 

• You join Captain Vineyards for harvest and/or bottling at your own will & risk as guest, intern or club member for learning experience.
• You are not considered or think that you are an employee of Captain Vineyards in any way.
• You join Captain Vineyards to have a farm experience and to learn the wine making process from crush/bottling.
• You are aware of the challenging terrains of the vineyard & accept the fact that it is uneven, unleveled, naturally occurring gopher holes and a uneven land.

WAIVER, RELEASE, HOLD HARMLESS AND AGREEMENT NOT TO SUE I, have read, fully understand that my participation in the Harvest or Bottling exposes me to the risk of property damage, personal injury or death. I hereby acknowledge my voluntary participation in these events and agree to assume any such risks. I hereby release, discharge and agree not to sue Captain vineyards and/or Sal and Susan Captain, its officers, employees and agents for any injury, death or damage to or loss of personal property arising out of, or in connection with, my participation in the Harvest or Bottling from whatever cause, including the active or passive negligence of Captain Vineyards and Sal and Susan Captain, its officers, employees and agents or any other participants in the event. The parties to this agreement understand that this document is not intended to release any party from any act or omission of “gross negligence,” as the term is used in applicable case law and/or statutory provision. In consideration for being permitted to participate in the Harvest and Bottling, I hereby agree, for myself, my heirs, administrators, executors and assigns, that I shall indemnify and hold harmless Captain Vineyards and Sal and Susan Captain, its officers, employees and agents from any and all claims, demands, actions or suits arising out of or in connection with my participation in these events.

I also understand that from time to time Captain Vineyards or representatives or others may photograph and videotape these events and participants. By signing this form, or attending the Harvest or Bottling I authorize the Captains to use or publish any images taken by them showing my participation. I HAVE CAREFULLY READ THIS RELEASE, HOLD HARMLESS AND AGREEMENT NOT TO SUE AND FULLY UNDERSTAND ITS CONTENTS. I AM AWARE THAT IT IS A FULL RELEASE OF ALL LIABILITY AND SIGN IT ON MY OWN FREE WILL. I FURTHER AGREE TO ABIDE BY AND ENFORCE THE RULES AND REQUESTS OF MEMBERS OF CAPTAIN VINEYARDS, AND CERTIFY THAT IHAVE READ THIS DOCUMENT AND UNDERSTOOD IT.
